With the windfall elimination provision officially repealed as of January 2025, millions of retirees and disabled workers who previously saw their Social Security benefits reduced due to having both Social Security credits and pensions from non-covered employment will now receive full benefits. based on their actual work history.
This change is significant for public sector employees such as teachers, police officers, and firefighters, as well as federal workers under the old civil service retirement system, who were often subject to monthly reductions of up to $587 under the old WP formula.
The Social Security Administration estimates that about 3% of all beneficiaries were impacted by WEP.
So, the immediate removal of these reductions means higher monthly payments for those affected, starting with checks issued after January 2025.
Importantly, this repeal does not affect supplemental security income recipients whose payments remain unchanged and tax-free, but it does increase retirement and disability benefits for those who had previously lost out due to WEP.
Survivors who received benefits based on a deceased spouse’s record were never subject to WEP, so their payments will not change.
Beneficiaries should review their upcoming statements for adjusted payment amounts and consider how the increased income may affect their overall tax situation, especially since higher Social Security payments can impact the amount of benefits subject to federal income tax depending on total household income.
With the windfall elimination provision affecting about 3% of all Social Security beneficiaries now repealed, millions will see higher payments starting with checks issued after January 2025.
